This article explains the main factors in the development of a secondment agreement. A secondment agreement should indicate that the Member complies with the host`s guidelines and procedures. Employers and original employers must also agree, as part of a distribution agreement, on the practical terms of payment and benefits and how costs are covered and reimbursed.
As a general rule, the worker`s original employer will pay for it and the host will pay it back. There are a number of essential concepts that employers and hosts must respect when entering into a secondment agreement: the Member can assert the usual rights at work against the latter. If they have also become collaborators of the host during the posting period, they may, at the end of the detachment, assert related rights (even if they return to the workplace for the detachment position). However, they need an appropriate permanent job at the host.
